Terms of Service - SD Collectibles LLC

Welcome to SD Collectibles LLC. These Terms of Service ("Terms") govern your access to and use of the website located at sdcollectibles.com (the "Site") and your participation in any events, card shows, or marketplaces organized by SD Collectibles LLC ("SD Collectibles LLC," "we," "our," or "us").

By accessing our Site or attending our events, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services or attend our events.

1. Introduction; Acceptance of Terms

SD Collectibles LLC organizes and hosts local trading card and collectible shows in the San Diego, California area. Our services include providing a venue for the purchase, sale, and trade of sports cards, Pokémon cards, and other Trading Card Games (TCG). We offer a marketplace where individual vendors and collectors can interact.

By accessing or using the Site, purchasing a ticket, registering as a vendor, attending an SD Collectibles event, or otherwise participating in our services, you agree to these Terms. If you do not agree, do not use the Site and do not attend our events.

2. Eligibility

By using this Site or attending an event, you represent that you are at least 18 years of age or are attending under the supervision of a parent or legal guardian. SD Collectibles LLC reserves the right to refuse service or entry to any individual at our sole discretion.

3. Event Attendance (Rules, Code of Conduct, and Buyer Beware)

By attending an SD Collectibles LLC event, you agree to follow these event rules and any additional rules posted onsite or communicated by staff.

General Rules: Follow staff instructions, respect the venue, and comply with all applicable laws and venue policies. SD Collectibles LLC may refuse entry or remove anyone at our sole discretion, including for safety, policy violations, or disruptive behavior.
Code of Conduct: To maintain a family-friendly and safe community atmosphere, you must refrain from harassment, hate speech, threats, intimidation, foul language directed at others, or aggressive behavior. Do not touch or handle someone else’s items without permission. No disorderly conduct.
Safety & Personal Property: You are responsible for your own belongings. Keep trade boxes, cases, and cash secure at all times.
Buyer Beware / Trading at Your Own Risk: SD Collectibles LLC provides a venue where collectors and vendors can buy, sell, and trade. We are not a party to individual transactions and do not guarantee authenticity, condition, grade, provenance, pricing, or future value of any item. Inspect and verify items (including card authenticity and condition) before completing any transaction. All deals are final between the parties unless the parties agree otherwise.
Disputes: If a dispute arises, we may (but are not required to) help de-escalate or facilitate communication; however, resolution is strictly between the buyer/seller/trader.

4. Payments & Refunds (Tickets and Vendor Table Fees)

Ticket Pricing: Entry fees and ticket prices are subject to change and may vary based on event location and ticket type.
No Refunds (Tickets): SD Collectibles LLC does not offer refunds directly for ticket purchases. All ticket sales are final.
Capacity / Entry Timing: Entry is subject to venue capacity limits. Purchase of a ticket does not guarantee immediate entry if the venue has reached legal occupancy limits.
No Refunds (Vendor Table Fees): SD Collectibles LLC does not offer refunds directly for vendor table fees or add-ons (including, without limitation, extra tables, corners, or power access). All vendor table fee payments are final.
Venue Cancellations / Alternate Venue: In the event that a venue cancels, SD Collectibles LLC will make reasonable efforts to secure an alternative venue to ensure the event proceeds. If an alternative venue cannot be arranged, we will contact ticket holders and vendors directly to provide refund options or further instructions.
Optional “Refund Protection” (Ticket Tailor; XCover): During checkout through Ticket Tailor, customers may be offered the option to purchase “Refund Protection” for an additional fee. Refund Protection (if offered and purchased) is provided and administered by our third-party partner, XCover, not SD Collectibles LLC. Refund Protection will be available starting May 18th, 2026.
Activation Required: To use Refund Protection, you must activate your XCover account using the activation link in your order/confirmation email.
How to File a Claim: All claims must be submitted directly through XCover at https://xcover.com/claim in accordance with XCover’s terms and requirements.
No SD Collectibles LLC Assistance / XCover Processes Refunds: SD Collectibles LLC cannot access, manage, or assist with XCover claims, decisions, or timelines. If a claim is approved, any refund/payment is processed by XCover directly (not by SD Collectibles LLC).
Third-Party Payments Between Attendees/Vendors: Payment methods accepted by vendors/collectors may vary (cash, card, digital payments, etc.). SD Collectibles LLC is not responsible for payment processing errors, chargebacks, fraud, or disputes arising from attendee-to-attendee or vendor-to-attendee transactions.

5. Vendor Terms (Separate Vendor Agreement/Policy)

Vendors must comply with the vendor terms provided during registration and any separate vendor agreement/policy applicable to a specific event (the “Vendor Agreement”). The Vendor Agreement may include, without limitation, table placement, setup/breakdown times, display and safety rules, prohibited items, and fee/refund terms for that event. If there is a conflict between these Terms and the Vendor Agreement, the Vendor Agreement will control for vendor-related issues for the applicable event.

Vendors are responsible for their own seller’s permits, tax obligations, inventory practices, and compliance with all applicable laws and venue rules. The sale of illegal items, prohibited weapons, or known counterfeit goods is strictly forbidden.

6. Code of Conduct

To maintain a family-friendly and safe community atmosphere, all attendees, vendors, and staff must:

Refrain from harassment, foul language, or aggressive behavior.
Respect the venue and the property of others.
Comply with all local, state, and federal laws.
SD Collectibles LLC reserves the right to remove any individual from an event without a refund for violating this Code of Conduct.

7. Media and Photography

By attending an SD Collectibles LLC event, you acknowledge that photography, audio, and video recording may occur. You grant SD Collectibles LLC the right to use your image or likeness in promotional materials, social media, and website content without compensation. For more details, please refer to our Media Policy.

8. Liability Disclaimer (Venue Provider; No Responsibility for Trades)

SD Collectibles LLC is a venue and event organizer that provides space for third parties (vendors and collectors) to interact. We do not buy/sell items in most attendee transactions and are not a party to individual sales or trades made at our events or arranged through our community.

To the maximum extent permitted by law, SD Collectibles LLC, its founders, staff, contractors, and venue partners are not liable for:

Third-Party Transactions: Any disputes, chargebacks, fraud, misrepresentations, non-performance, or losses arising from transactions between attendees, vendors, or other third parties. Participation and all transactions are at the attendee’s and vendor’s own risk.
Authenticity/Condition/Value: Any claim that an item is counterfeit, altered, misgraded, stolen, or otherwise not as represented; any disagreement about condition or grading; or any market/value fluctuations before or after a transaction. SD Collectibles LLC is not responsible for any counterfeit items.
Personal Injury / Property: Any personal injury sustained at an event or any lost, stolen, or damaged property (including collections, trade boxes, cases, cash, and electronics), except to the extent caused by our gross negligence or willful misconduct where such limitation is not permitted by law. SD Collectibles LLC is not responsible for items that are lost or stolen during or after our events.
Site Use: Any indirect, incidental, special, consequential, or punitive damages arising from use of the Site or attendance at our events.

9. Indemnification

You agree to indemnify and hold harmless SD Collectibles LLC from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms or your conduct at an SD Collectibles event.

10. Intellectual Property

The Site and its content (including text, graphics, logos, photos, designs, and overall look and feel) are owned by SD Collectibles or its licensors and are protected by intellectual property laws. You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from our content without our prior written permission, except for normal browsing and personal, non-commercial use.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in San Diego County, California.

12. Changes to Terms

We may update these Terms from time to time to reflect changes in our practices or legal requirements. The "Effective Date" at the top of this page will indicate when the latest changes were made. Your continued use of the Site or attendance at events constitutes acceptance of the updated Terms.
